Terms & Conditions
Quotes and Formation of Agreement:
All quotes are non-binding and valid for 30 days. The agreement is established following written confirmation or digital signature by the client.
Payment Structure (30/30/40):
Bigtime applies the following billing stages to cover production costs: 30% upon commencement: Invoiced upon approval of the quote. Work begins after receipt of this payment. 30% after the filming day(s): Invoiced immediately after completion of the recordings. 40% upon delivery: Invoiced upon delivery of the final video. Invoices must be settled within 30 days of the invoice date.
Locations and Permits: Responsibility:
The client is responsible for arranging access to locations and obtaining the necessary filming permits, unless explicitly agreed otherwise. Permission: The client guarantees that Bigtime is authorized to film at the chosen locations. Any fines or delays resulting from the lack of permission or permits are entirely at the client's expense.
Revision Rounds & Feedback:
Quantity: The quoted price includes two standard revision rounds. Procedure: Feedback must be consolidated and submitted in writing within 7 working days after receipt of a version. Additional Work: Adjustments after the second round, or changes that deviate from the originally approved script, will be invoiced at the applicable hourly rate.
Intellectual Property Rights & Raw Footage:
Usage Rights: The right to use the footage is granted following approval via email and/or full payment of all invoices. Raw Footage: Bigtime only delivers the edited video(s). Raw footage is not provided by default but can be purchased for an additional fee, to be determined per project. Portfolio: Bigtime reserves the right to use the work for its own promotion, unless an NDA has been agreed upon in writing.
Licenses (Music & Media):
The project price includes licensing costs for stock music and media purchased by Bigtime for the respective video. These licenses are limited to the intended use described in the quote.
Travel Expenses and Costs:
Mileage Allowance: Travel expenses are invoiced separately based on subsequent calculation at a rate of €0.50 per kilometer. Unless stated otherwise in the quote. Other Costs: Parking fees, location rental, and catering at the client's request will be charged one-on-one.
Cancellation (Kill Fee):
In the event of cancellation or postponement of a planned filming day by the Client: Within 48 hours before commencement: 50% of the relevant project phase. Within 24 hour before commencement: 100% of the relevant project phase.
Data Storage and Archiving:
Standard Storage: For every project, a standard 'Data Archiving Fee' of €90.00 excl. VAT is charged in the quote. This guarantees that Bigtime will securely store all project files (source files, project files, and final deliverables) for one (1) year after the initial delivery.
Automatic Renewal: After the first year, the storage service is automatically renewed annually. The costs for this are €45.00 (excl. VAT) per project per year.
Service: During the active storage period, requests for the delivery of specific individual files or the final video are included in this price.
Termination: The client may terminate this service in writing after the first year. Upon termination, the client has two options:
- Permanent Deletion: Bigtime irrevocably deletes all files from its systems.
- Transfer via HDD: Bigtime delivers all project files on an external hard drive (HDD) for a fixed amount determined by Bigtime.
Liability: Although Bigtime maintains diligent backup procedures, it is not liable for data loss due to force majeure (e.g., fire or external server failures) beyond legal frameworks.
